LAW 859 - ANTITRUST LAW/CONSTITUTIONAL PROTECTION

Description A study of the laws regulating economic competition and collaboration in our free enterprise system, with an emphasis on such key federal statutes as the Sherman, Clayton, and Federal Trade Commission Acts, and state unfair trade practice and consumer protection laws. Subjects include civil and criminal enforcement actions by the United States and the Federal Trade Commission, as well as private treble damages and state parens patriae suits in the context of such practices as illegal mergers and acquisitions, price-fixing, monopolization, vertical foreclosure and exclusive dealing, and group boycotts. A focus of the course will be the different phases of such suits, including pre-trial investigations and procedures (such as depositions), as well as the actual trials.
